Resumen

El art. 2 del CPP prescribe que, si el imputado y la víctima llegan a un acuerdo y este consta en un documento privado legalizado notarialmente, no será necesario que el fiscal penal convoque a una audiencia para promover el principio de oportunidad. Sin embargo, este procedimiento tiene la falencia de que en los despachos notariales se da fe de que la firma que consta en dicho documento corresponde a quien lo suscribe, mas no se deja constancia de que los suscribientes conozcan sus efectos jurídicos, lo que podría ser aprovechado por el imputado para inducir a error a la víctima y no cumplir con el pago indemnizatorio. En el presente artículo, los autores proponen que el fiscal penal, a pesar de que en el proceso bajo su investigación se ofrezca un documento privado legalizado notarialmente del acuerdo entre el imputado y la víctima respecto a la reparación civil, convoque a una audiencia para que la víctima se ratifique en el contenido del mismo y se le explique sus alcances jurídicos en la investigación.

ABSTRACT

The art. 2 of the CPP prescribes that, if the accused and the victim reach an agreement and this is recorded in a private document legalized by a notary, it will not be necessary for the criminal prosecutor to call a hearing to promote the principle of opportunity. However, this procedure has the shortcoming that notarial offices certify that the signature that appears in said document corresponds to the person who subscribes it, but there is no record that the subscribers know its legal effects, which could be used by the defendant to mislead the victim and not comply with the compensation payment. In this article, the authors propose that the criminal prosecutor, despite the fact that in the process under his investigation a notarized private document of the agreement between the accused and the victim regarding civil reparation is offered, convene a hearing so that the victim is ratified in the content of the same and its legal scope in the investigation is explained.
