Resumen

El presente artículo tiene por objeto presentar una forma de enfrentar la sobrecarga laboral en el Ministerio Público, precisamente atacando el problema medular, la “cesión del titularato de la acción penal y la dirección de la investigación”. Desde la creación del Ministerio Público, se ha establecido una regla, cuyo fundamento se desconoce, por la que los fiscales no solo reciben la noticia criminal, sino además deben prestar oídos a las sugerencias de calificaciones jurídicas contenidas en la denuncia, lo cual genera un grave retraso en la tramitación de causas y un entorpecimiento a la labor fiscal, a tal punto que, cuando un fiscal no se pronuncia sobre una de las múltiples sugerencias típicas deslizadas la denuncia, se conmina luego al órgano fiscal superior a disponer la nulidad. Por ello, el autor propone hacerle frente a este problema reivindicando el titularato de la acción penal, a través de la correcta recepción de la noticia criminal, es decir, el hecho debe merecer la calificación jurídica del fiscal, sin vincularse necesariamente a las proposiciones jurídicas alcanzadas por el denunciante, el agraviado o sus patrocinios técnicos. Una consecuencia inmediata de esta proactiva actitud será la racionalización de horas hombre y recursos logísticos en el Ministerio Público.

ABSTRACT 

The purpose of this article is to present a way to face the work overload in the Public Prosecutor's Office, precisely by attacking the core problem, the "transfer of the ownership of the criminal action and the direction of the investigation". Since the creation of the Public Prosecutor's Office, a rule has been established, the basis of which is unknown, whereby prosecutors not only receive the criminal notice, but must also listen to the suggestions of legal qualifications contained in the complaint, which generates a serious delay in the processing of cases and a hindrance to the work of the prosecutor, to the point that when a prosecutor does not rule on one of the many typical suggestions made in the complaint, the higher prosecutorial body is then required to order the nullity. Therefore, the author proposes to face this problem by claiming the ownership of the criminal action, through the correct reception of the criminal notice, i.e., the fact must deserve the legal qualification of the prosecutor, without necessarily being linked to the legal propositions reached by the complainant, the aggrieved or their technical sponsors. An immediate consequence of this proactive attitude will be the rationalization of man-hours and logistic resources in the Public Prosecutor's Office.
