Resumen

El autor advierte que juzgadores, fiscales y abogados defensores carecen de una orientación razonada que les permita interpretar correctamente la segunda garantía de certeza que establece el AP N.° 2-2005/CJ-116 para establecer sin apasionamientos la verosimilitud del único testigo. Si bien existen diversos pronunciamientos supremos, ninguno ha definido las corroboraciones periféricas de carácter objetivo; lo cual genera condenas erradas por falta de una debida interpretación y consecuente aplicación. Es por ello que el autor busca responder a la pregunta: ¿qué significa que la versión del único testigo debe estar rodeada de ciertas corroboraciones periféricas, y que estas a la vez sean de carácter objetivo?

The author warns that judges, prosecutors and defense lawyers lack a reasoned orientation that allows them to correctly interpret the second guarantee of certainty established in Plenary Agreement N.° 2-2005 / CJ-116 to establish ―without passion― the credibility of the only witness. Although there are several supreme pronouncements, none has defined peripheral corroborations of an objective nature; which generates wrong sentences for lack of proper interpretation and consequent application. That is why the author seeks to answer the question: what does it mean that the version of the only witness must be surrounded by certain peripheral corroborations, and that these ―at the same time― are of an objective nature?
