Resumen

El objetivo de este artículo consiste en consolidar el acierto de la Corte Superior de Justicia de Lima en el fallo que favorece en parte el petitorio de Ana Estrada Ugarte y le posibilita disponer de su libertad de decisión a fin de alcanzar la muerte como remedio a su padecimiento constante y progresivo. En este sentido, analizamos las formas de eutanasia (voluntaria activa, voluntaria pasiva y el suicidio asistido) y el tratamiento que le dan las legislaciones nacional y extranjeras. Finalmente, abordamos los argumentos de la sentencia de la Corte Superior y los derechos implicados en el caso.

ABSTRACT 

The objective of this article is to consolidate the success of the Superior Court of Justice of Lima in the ruling that partially favors the petition of Ana Estrada Ugarte and allows her to have her freedom of decision in order to achieve death as a remedy for her constant and progressive suffering. In this sense, we analyze the forms of euthanasia (active voluntary, passive voluntary and assisted suicide) and the treatment given by national and foreign legislation. Finally, we address the arguments of the Superior Court judgment and the rights involved in the case.
